Am I Eligible?

The Record Suspension applies to adults who were convicted of an offence in Canada or were transferred to Canada from another country while serving their sentence. Following this requirement, there are conditions that must be met to determine your eligibility:

The required wait period has been completed, as determined by the date of your first offence; and

You must have completed all sentences, even from the date of your last offence, which can include but are not limited to, paying all fines, meeting all terms of imprisonment, and/or completing any probation orders.

Determining Your Eligibility

The date of your first offence determines your eligibility criteria as seen below.


*If you have been convicted to a prison term of 2+ years for more than three indictable offences OR were convicted of an offence found in Schedule 1 of the Criminal Records Act and do not meet the exception criteria, you are not eligible for a record suspension. A Summary Conviction is a crime where a judge handled the conviction and you were required to attend court.

Definition of Sentence Terms

An Indictable Offence is a crime where you were arrested, had to attend court for trial (involving possibly a jury or enter a plea).

A Serious Personal Injury or a Schedule 1 offence includes manslaughter with 2+ years in prison with indictment.
